Supreme Court Demands Recount in Grand Bassa District#5 Representative Election

IPNEWS: The Supreme Court has ordered the National Elections Commission (NEC) to conduct a recount of votes in polling places such as Old Camp with Precinct code 09007, Zono Precinct with code 09013, and Gbowee Precinct with code 09034, in Grand Bassa County District #5.
The court also denied a request brought by Madam Christine Juah Setro Dennis (appellant) of the Unity Party (UP) for a re-run in Prescient Precinct 09013, Zondo Town School.

The candidates who appealed the election results, Madam Christine Juah Setro Dennis of the Unity Party (UP) stated that in the Zono Precinct voters were denied their right to vote; saying the supervisor at the precinct closed the center after 6 p.m., even though many voters were still waiting in the line.
The Unity Party representative candidate pointed out issues at polling places such as Old Camp with Precinct code 09007, Zono Precinct with code 09013, and Gbowee Precinct with code 09034, among others.
She alleged that the National Elections Commission (NEC) workers at those locations denied entry to voters; adding that during the process, the polling staff called on the police who were assigned there to escort voters outside the polling area, thus preventing them from casting their ballots.
In the case of Zono Precinct, she alleged that voters were denied their right to vote; saying the supervisor at the precinct closed the center after 6 p.m., even though many voters were still waiting in line.
“In the Gbowee area, the ballot boxes arrived late in the night, and many voters had already left, leaving only election workers to cast their votes,” Madam Setro-Dennis alleged.
The UP candidate informed the media that a complaint was initially filed with the local magistrate in Buchanan, but due to concerns of alleged partiality, the case was transferred to Monrovia at NEC headquarters for hearing.
The aggrieved candidate also expressed her concerns over threats to her and her supporters’ lives since the case was moved to Monrovia. “I have the recordings of the threats made against me and my followers,” she claimed.
The court said Wednesday that the challenges were “devoid of merits.” The ruling clears the way for a recount and not a re-run. In the majority ruling, the court said, Candidate Setro Dennis’ evidence that polls were opened
from eight O’clock in the morning and closed at Six O’clock in the evening, and her witnesses’ testimonies not having shown the contrary, her request for a rerun in precinct 09013, Zondo Town Public School cannot be sustained.
The court noted that mere allegations do not constitute proof, and unless such allegations are supported by evidence, they shall remain mere allegations. It is evidence alone which enables the court, tribunal, or administrative forum to pronounce with certainty the matter in dispute. ” In the instant case, Setro Dennis’
haven alleged that there were alterations and inconsistencies in the Representative Records of the Counts in two polling places in District #5, but failed to produce the Representative Record of the Counts to substantiate this allegation, same cannot be sustained.
That, however, the recount process being equitable, and considering the narrow vote margin of 49 between the first two highest votes-obtaining candidates, a recount of the entire vote cast in the Electoral District #5 of Grand Bassa County is imperative.
