Liberia: Cllr. Johnny Momoh, others Escape Jail Sentence theft of property case

IPNEWS: Liberia Criminal lawyer, Cllr. Johnny Momoh and several others co-defendants on Saturday, March 30, 2023 escaped jail sentence after securing a valid surety Criminal apperence bond.

Cllr. Momoh and several co-defendants had been charged with the crimes of burglary and theft of property in the average amount of US$S575,385.00 pulse LRD$80,000 at the Brewerville Magisterial Court.

On Saturday, the Brewerville Magisterial Court which was a displayed of drama, order Cllr. Johnny Momo and several others arrested to answer to the charges due to a complaint filed by his embattled fiancee, Ms. MARIE NALLON.

According to the writ of arrest which is in tbe possession of this IPNEWS l, ordered the living bodies of Cllr. Momo and others.

” YOU ARE HEREBY COMMANDED T0 ARREST THE LIVING BODY/IES OF
PANNOH, AUGUSTINE, JOHNNY MOMOH, JOHNNY YORVOR, EMMANUEL SALLAY, PATRICAL, MIATTA KAMARA.MoSES MALLA AND OTHERS OTHERS DEFENDANTS TO BE IDENTIFIED AND FORTHWITH BRING THEM BEFORE THIS COURT TO ANSWER TO THE CHARGE/S BURGLARY AND THEFT OF PROPERTY BASE UPON THE OATH COMPLAINT OF MARIE NALLON AS FOLLOW TO WRIT” the writ noted.

The writ stated that the private prosecutor complains against the defendants, and said that at her resident at Y.ED community, Saturday the 8 day of April 2023, at 8:00 A.M. the defendant principle Johnny Momoh, proceeded to her resident where she has resided over two(2) years pulse without any color of right proceeded along with co defendants burst her door were she had all of her belongings.

The writ terms the alleged action as criminally, unlawfully and was carryout while the private prosecutor was out of the fence and had gone to take her COVID-19 vaccine to lead to china.

The writ explained that at that time, the defendants entered the premises, broke the doors and went in with the codefendants and others to be identified and allegedly stole, took. and carry away several belongings from the private prosecutor to include.

“The private prosecutor jewelries value at US$500,000.00USD and cash amount of US$75,385.00 pulse LRD$80,000.00, amounting to the total of US$S575,385.00 pulse LRD$80,000 which was the private prosecutor hard earn business money and the value of her gold jewelries” the writ pointed out.

The private prosecutor says further that upon her arrival into her resident, she saw the defendant principle with the others co-defendants taking and carrying away her belonging as named herein and that her jewelries wherein was placed in a gray bag which also contained
within it foreign currencies to include Ghana cedes, Guinea France, Gambia money Euro, CFA Chania’s RMB, south African money, Kenyan money, Sierra Leones, Moroccan money in
various amount.

“The act of the defendants being criminal, wicked and intentional the crimes of Burglary and theft of property the defendants did do and commit” the writ concluded.

However, when the writ was served on the defendants, they were brought at the court but the prosecution request the court to inform the defendants about their constitutional and statutory rights since it’s their first apperence.

” At this stage, the prosecution request this court in line with section 1.6 paragraph 4 of the Criminal Procedure Law give the defendants up to Thursday, April 4, 2024 to take advantage of the law within Chapter 13.13 Criminal Procedure Law. Failure on their part, the law shall be applied ” they noted.

To this, the defendants inter-posese no objections since the application is inline with the law and today being the first apparence and sitting of the defendant.

” The defendants are having a solid and valid criminal apparence bond and awaiting your approval your honour” the concluded.

Finally, the court granted the request of the prosecution and approved the criminal apparence and said that they will commence the case on Thursday, April 4, 2024. (By Taisiah Merfee)
