Judge Kennedy Peabody Summons MoJ-LNP for Damages of Wrongful Death

IPNEWS: The Resident Judge of Civil Law Court at the Temple of Justice, Judge Kennedy Peabody issues a Writ of summon for the Ministry of Justice and the Liberia National Police for damages of wrongful death

The court’s summon is in reaction to the death of a three year old child identified as Francis Mansah who was reported to have died as a result of an alleged coal pot that was kicked by a female officer in the township of west point while enforcing the health protocols.

But, Judge Peabody on July 1, 202l further ordered the Sheriff of Montserrado to summon MOJ and LNP to file their returns to the petitioner’s petition on or before the 11th day of July, A.D 2021and that upon their failure to appear, judgment by default will be rendered against them.

He informed the Sheriff to return the original Writ of Summons to his office on or before July 11, 2021 with the official returns endorsed on the back of the original as to the manner of its service.

Following the death of the late Francis Mansah, the LNP, said in its investigative findings that on April 20, 2020, Patrol Officer Sonnie Jallah began to warn the residents to leave the streets.

It says Cpl. Dugbe told the investigators that in the process, she noticed a man (she thought to be the grandfather of the child) holding the child on his laps.

She further told the LNP, investigative team that upon hearing this warning or command, the man pushed this child to the Grandmother, but the grandmother was not attentive, so the child fell under the table where the coal pot was which resulted to the hot water splashing on the child.
