IPNEWS – Kakata – The 13th Judicial Circuit Court in Kakata, Margibi County, has set free the junior brother of Montserrado County Senator Abraham Darius Dillon from prison after two years in prison.
Oliver Dillon, who had been held by the state on murder charge, had denied all charges including murder, placed on him by the state.
Oliver’s arrest became a political tussle and discussion at most spots were mainly men gather to argue about the nation’s problems.
The Margibi Circuit Court’s Judge Joe Barcon acknowledged the unanimous acquittal verdict of all the 12 jurors on Thursday, January 14. The jurors had adjudged Dillon not-guilty of the charges brought against him by the state.
Than the judge declared the younger Dillon a free man and restored all his rights and civil liberty. He also ordered the bond be restored to him.
Background to the Case
Oliver Dillon had been arrested and sent to court for allegedly killing Emmanuel Kofi, who is said had allegedly attacked him, in the Barnesville Community, in April 2019.
After he was investigated and charged, he was forwarded to court for prosecution. He was indicted in November 2019 by the Grand Jury of Montserrado County for the crime of murder.
The trial officially commenced on November 16, 2020, with the selection of a 15-man juror panel to preside and make a determination into the matter.
As the trial went on, the prosecuting team produced three witnesses: Alvin Page and George Quaye, who were called in to testify to Dillon’s involvement in crime.
Montserrado County Attorney, Edwin Kla Martin, who led the state prosecuting team, in his final argument on Thursday, insisted that Dillon’s argument of self-defense violates the theory of self-defense on grounds that under the law one should be in an eminent danger or provoked which was never the case in this matter, according to him.
Martin further maintained that Dillon only just saw a group of people coming towards him and concluded they were criminals, pulled a weapon and struck Kofi.
However, the police investigative report acknowledged that the area where the incident occurred is massively infested with criminals and known to be a crime bleeding community where gangs go after peaceful citizens and take away their belongings.
Arguing on behalf of the defense, Wilfred Sillah pointed out that there was no autopsy conducted to establish the where on the deceased remains was pierced to have resulted to his death. Another vital point that Cllr. Sillah brought to the fore is that the police charge was prepared April 12, 2019 at the 2300 hours, a day before the crime was committed on April 13, 2019. He strongly argued that the government might have anticipated the incident before it occurred.
Cllr. Sillah further argued that Alvin Page, a Police examiner who conducted the test on the deceased is not a medical practitioner and should not have been the one to establish the cause of death rather a licensed and professional medical doctor, something that was never done instead he contacted a nurse aid to test the deceased.
After making his argument, Sillah than pleaded to the consciences of the jurors to bring down a non-guilty verdict in favor of his client.
