IPNews-Monrovia: A Liberian girl currently residing in the Kingdom of Belgium, is calling for Justice following allegation of rape committed by current Managing Director, Monrovia Club Breweries (Club Beer).
In a dispatch from her base in Brussels, Miss Almaz Jalloh alleged that Dr. C. Nelson Oniyama raped her in 2013, which eventually led to her being pregnant.
Miss Jalloh alleges that following her discovery that she was pregnant after the rape, informed Dr. Oniyama but he vehemently rejected the allegation and pregnancy which subsequently followed series of persistent intimidation and threats towards her by Oniyama after she demanded a DNA test be carried out once the child was born to proof her accusation.
Almaz Jalloh, claimed that the DNA sponsored by Dr. C. Nelson Oniyama and conducted by the Medline Hospital, was manipulated.
She stated that the first DNA test conducted in 2014, which was sponsored by Nelson. Oniyama, was secretly sent to the DDC Hospital, United States without her knowledge or approval which lasting nearly two month before being announced ‘NAGATIVE’, contrary to usual medical DNA test result within three to five days.
Narrating further, Madam Almaz Jallon told IPNews that she rejected the results consisted with her conscience and quest to ensure justice is served for the dehumanizing state of mind and body in which Dr. Oniyama has inflicted upon her and demanded a follow up DNA test which was subsequently conducted in 2015, at the Alphabiolabs Hospital in the United Kingdom.
She stated furthermore that the results from the second DNA conducted in the UK proves ‘POSITIVE’, to which Dr. Oniyama rejected and requested another test recommending a renew one in in the Federal Republic of Nigeria.
“When the result came, it was positive. Nelson refused the result because he didn’t wanted me to use it in court. Then during this time Nelson appeal and said that he had realized what he did to me and he was ready to face the consequences of his actions and requested that I meet with him at his Riverside residence for discussion which I initially refused knowing the person to whom I was dealing with but later some family members asked and hear what he had to tell me.”
“Unfortunately and sadly, upon my arrival at Mr. Oniyama residence, I was again forced into sex and raped again by Dr. C. Nelson Oniyama, which resulted into my second pregnancy. He bagged and promised to take care of me and the kids but ‘I should keep it quiet’, which I refused.
“Here is the outcome of the second rape. This is my son Frédéric! , I did not know he wanted another chance to rape me and that I will fight to bring him to justice”. Miss Almaz Jalloh narrated.
But an independent investigation conducted by the Independent Probe Newspaper, states that Madam Almaz Jalloh and Dr. C. Nelson Oniyama, were lovers and conducting their activities regularly until the contestation about the proof of fatherhood emerged.
According to our investigation, the initial DNA conducted by the pairs meant the full consent of Madam Jalloh, including her dispatching the specimens to the USA contrary to earlier statement by Miss Jalloh that the DNA Specimens conducted secretly.
Atty. Vivian Neal, lawyer representing Miss Jalloh, states that ‘at no time during resolution of the matter did miss Jalloh engaged the Female Lawyers of Liberia she was being raped by Dr. Nelson Oniyama.
Atty. Neal said the issue contested by Miss Almaz Jalloh were purely and solely the surety of the DNA test sand the paternity contrary to renew contestation of ‘rape” committed against her.
Neal stated that Miss Jalloh in the presence of the Female lawyers representing her conducted three separate DNA with results proving all ‘Negative’.
She narrated that following those medical results at the Kingdom Care Medical Foundation, the parties agreed through a ‘stipulation agreement’ that the last DNA conducted was the last and final with the matter settled that the pregnancy was not Mr. Oniyama.
A copy of the stipulation agreement dated May 30, 2018, obtained by the Independent Probe Newspaper, signed between by Dr. Nelson Oniyama, and lawyers including Miss Almaz Jalloh, represented by Atty. Vivian Doe Neal, President of AFFELL and attested by Dr. Martha N. Zarway, Chief Medical officer, Kingdom Care Medical Foundation, states that: “Therefore, the parties herein have agreed ad satisfied that the results of the tests conducted with respect to the paternity of the children are final and binding and that no further tests should be conducted with regard to the paternity of the aforesaid children; except for proven irregularity and/or fraud’.
Miss Jalloh continuously insist that the results of the DNA test was never share with her but rather Dr. Oniyama reflecting ‘NAGATIVE’, which she continue to contest its validity.
Interestingly, alleged rape victim Jalloh challenged the DNA results on ground that the ‘DNA Makers of Ann-Marie was completely different as in the case of all previous DNA test conducted.
Miss Jalloh: “So I took the various reports to Belgium and asked a forensic expert to investigate and that was when I was informed that all of those DNA tests where all ‘fraud and that if they go by the results as specified in the subsequent DNA reports, than I am not the biological mother of the child which is not possible because I gave birth to Ann-Marie through C-section.”
“Given the continue trauma I am continuously undergoing, I than decided to raise this in 2018 that I will get Justice for the inhumane acts of rape and forceful sexual intercourse committed against my person.”
When requested by this paper to provide proof of the forensic examination, Madam Jalloh is yet to show until press time.
However, confident Jalloh told IPNews that contrary to assertions by Dr. C. Nelson Oniyama that the DNA conducted were all professionally carried out, the various laboratory results were all mistakes and not having standards, except the DNA conducted in the United Kingdom whoch proves ‘Positive’. .
Jalloh stated that she already contacted all of those laboratories to confirmed if those results where authentic and the one labs abroad said base on the specimens received, the results were one hundred percent correct and that they can’t be held reliable of any ‘fraud or irregularities’.
Madam Jalloh contested that it was unfortunate to have series of stage managed DNA results by Dr. C. Nelson Oniyama, given that this single child has been given more than three DNA makers which should not have been the case rather all test should have been consistent since it was the same child been tested all through.
Our investigation further proved that Madam Jalloh initially contacted the Female Lawyers of Liberia, to assist her by ensuring Dr. Oniyama owed up to his the children and not rape. The concern now is when did the issue of rape ensue?
A communication address to former Montserrado County Anthony , Diaku Mulbah, obtained by IPNews and dated August 16, 2018, called on the Montserrado County Anthoney to ensure the ‘arrest and incarceration of Mr. Nelson Oniyama, for rape which has caused her (Miss Jalloh), method stress and uncertainties.
When this paper contacted lawyers of Dr. Nelson Oniyama, Cllr Johnathan Boima Lassannah, stated that the matter has been decided at the civil law court with a no guilty verdict and speaking to the matter is not the rightful option under the laws of Liberia.
Cllr. Lassannah said if Madam Almaz still feel aggrieved over the ruling or the adjudication of the matter in court, there are recourse to the law and the continuous action to parade the name of its client in the media is unacceptable.
“Liberia is a global village, and if miss Jalloh got substantive issue to counter or disprove earlier DNA or ruling of the honorable court, why don’t Miss Jalloh file a legal suit whosesoever she is and she if the truth will not be reveal again as exemplified in the count.” Cllr Lassannah told IPnews.
But court document in the possession of IPNews clearly states that Miss Jalloh was never present in court for the 38th day Jury sitting of the June Term of Court, on August 5, 2019, when a judgment was handed down by Yamie Gouiou Gbeisay, Assigned Circuit presiding Judge, Sixth Judicial Circuit Court ‘B’, Montserrado County, Republic of Liberia.
In his ruling, Judge Gbeisay, stated that accordingly, Plaintiff requested court to, and the court ordered the Sheriff to call the name of Defendant Almaz Jallah three times at the entrance of the court to ascertain whether the said Defendant was within the bailiwick of the court.
Judge Ghaisay also noted that returns of the court by the Sheriff revealed that the Defendant was not within the bailiwick of the court, during which time the Plaintiff therefore prayed and the court granted Plaintiff a ‘default Judgment’ which was made perfect after the production of evidence by the Plaintiff.
Court records states that the Plaintiff paraded before the court two witness whose testimony substantiated the averments contained in the compliant. The testimony of the witness were incorporated into the final judgment, according to Judge Yamie Gbeisay.
But when asked whether she (Almaz Jalloh) received a citation for the court proceedings, Miss Jalloh, uprightly denied ever receiving any notification or summons from Yamie Gouiou Gbeisay, Assigned Circuit presiding Judge, Sixth Judicial Circuit Court ‘B’, Montserrado County, Republic of Liberia.
“I reject that assertion of receiving a court notice and didn’t show up, Miss Jalloh told IPNews”.
However, the final judgment handed down by Judge Gbeisay, held defendant Almaz Jalloh, for general damages in the amount of US$ 1.5 Million United States dollars.
But Miss Jalloh, said the ruling was mockery to the rule of law and fair Judgment, an attempt to silence her and has vowed to fight the matter to the end.
Responding to Miss Jalloh claims of the judgment being a ‘mockery to the rule of law and fair Judgment, Cllr. Lassannah challenge Miss Jalloh to move to the court and express her disgust.
Now, it remains unclear whether or not did Miss Almaz Jalloh, received a citation or summons from the court as required by law to appear for these court proceedings. Investigation continues. Watch out for Part II.
